Adoption Q and A

  1. Who can place a child for adoption? Any person or organization having the right of consent to a child may place that child for adoption. This would include birth parents or the child's legal guardian or guardian ad litem, as well as organizations such as the Department of Social Services or child placing adoption agencies.
  2. What is an agency adoption? In every state, a state agency or licensed private child placement agency may complete an adoption. In a newborn infant adoption, the birth mother usually consents to the termination of her parental rights and transfers those rights and custody of the child to the agency for the purpose of adoption. The child remains in the custody of the agency until placement with the adoptive parents. The agency will obtain consent to terminate the birth father's rights where possible. When the agency is unable to locate the birthfather, or if the birth mother refuses to name the birth father, the agency shall move for an involuntary termination.
